{"id":58151,"date":"2016-09-15T14:10:06","date_gmt":"2016-09-15T12:10:06","guid":{"rendered":"https:\/\/sanchez-cervera.com\/invalidity-of-floor-clause\/"},"modified":"2025-02-26T14:01:02","modified_gmt":"2025-02-26T13:01:02","slug":"invalidity-of-floor-clause","status":"publish","type":"post","link":"https:\/\/sanchez-cervera.com\/en\/invalidity-of-floor-clause\/","title":{"rendered":"Invalidity of \u2018floor clause"},"content":{"rendered":"&#13;\n<p>15 September 2016<\/p>&#13;\n&#13;\n<p>S\u00e1nchez-Cervera Abogados advised a client of a financial institution (now part of Liberbank) to claim the nullity of the so-called \u2018floor clause\u2019 of his mortgage loan, which set a minimum annual interest rate of 4% (much higher than the agreed variable rate of Euribor + 1.5 points), The claim was upheld in full, declaring the aforementioned floor clause null and void and obliging the bank to return the amounts paid in excess retroactively from 9 May 2013 (date of the fundamental ruling of the Plenary of the Supreme Court declaring similar clauses null and void). The judgment also ordered the defendant to pay interest and costs.
