Sánchez-Cervera Abogados advises the owners of an insolvent company, charged with an alleged fraud offence in proceedings brought by two of the company’s creditors.
The Madrid Provincial Court upheld the appeal and dismissed the case as it was established, among other things, that the suppliers were aware of the company’s financial difficulties, to which they voluntarily decided to supply goods. Lack of sufficient deception and of error determining an act of disposal of assets.
