Sánchez-Cervera Abogados advised a client of a financial institution (now part of Liberbank) to claim the nullity of the so-called ‘floor clause’ of his mortgage loan, which set a minimum annual interest rate of 4% (much higher than the agreed variable rate of Euribor + 1.5 points), The claim was upheld in full, declaring the aforementioned floor clause null and void and obliging the bank to return the amounts paid in excess retroactively from 9 May 2013 (date of the fundamental ruling of the Plenary of the Supreme Court declaring similar clauses null and void).
