The European Court of Human Rights has found that Spain has violated a Spanish citizen’s right to a fair trial by convicting him of libel at second instance without having heard him after he was acquitted at first instance.
The TEDH has already condemned Spain on previous occasions for this very reason, as it violates the European Convention on Human Rights, and the right to the so-called ‘double criminal court’ recognised in the International Covenant on Civil and Political Rights of New York.
